"New York State Extends Group Health Insurance Continuation Coverage from 18 to 36 Months and Allows Coverage Under Parents’ Policies for Unmarried Children Up to Age 29"

 Employers should be aware that recent amendments to the New York State Insurance Law have extended group health insurance continuation coverage from 18 to 36 months and allow coverage under parents' policies for unmarried children up to age 29.  This Stroock Special Bulletin looks at who is affected, details of the extension, the special enrollment period for individuals who elected COBRA before the extension was enacted, the effective date of the extension, and a potential ERISA preemption issue in connection with the COBRA extension.
