“New NYC Department of Buildings Development Challenge Process To Take Effect On July 13, 2009”

As announced by the New York City Department of Buildings (“DOB”) on June 9, 2009, the new DOB development challenge process (the “DOB Process”), first introduced on February 2, 2009, will become effective on July 13, 2009. Though there were numerous comments from the public since its first introduction, the DOB Process remains largely unchanged, with one important exception: the DOB Process now gives the public 45 days, rather than 30 days, to review and challenge zoning approvals by the DOB for new developments and alteration enlargements of existing buildings. The DOB Process does not retroactively apply to applications that are filed prior to July 13, 2009.
