Does an employee's use of his or her authorization to access an employer's computer system violate the Computer Fraud and Abuse Act (CFAA) when the employee uses the computer for purposes contrary to the employer's interests? The United States Circuit Courts of Appeals have not spoken with one voice on this issue, creating a split in the circuits that has yet to be resolved by the U.S. Supreme Court.
