"Prioritized ('Track I') Examination"

In connection with the enactment of the Leahy- Smith America Invents Act, the United States Patent and Trademark Office ("USPTO") implemented Prioritized Examination, also known as "Track I" examination, on September 26, 2011. Prioritized Examination is intended to provide Special Status to certain applications with the goal of obtaining a final disposition to the application within 12 months.1 Currently, average pendency of a patent application between filing and final disposition is about 34 months.
