Ross Moskowitz, a partner in Stroock’s national Real Estate Group and head of the Land Use and Zoning team, was quoted in a Politico article titled “Inwood Rezoning Can Proceed Under Appellate Court Ruling.”

Ross weighed in on the Appellate Division’s 5-0 decision to reverse a lower court ruling that struck down the rezoning plan for the Manhattan neighborhood. As the publication noted, the appeals court ruling clarifies the parameters for the requirements of environmental review.  

“The Appellate Division has clarified that line and made clear this is a legislative decision,” Ross said. Had the lower court’s ruling been upheld, “that would have created this sort of open door policy and a slippery slope of claims being made that have no reference point in policy or legislation.”
