In a recent article for One on One headlined “Misrepresentation or Just ‘Puffing,’” Martin Minkowitz looks at the issue of whether it is permissible to exaggerate a client’s position, particularly in settlement negotiations.

“If the ‘puffing’ is only an expression of mere opinion or belief and not represented as a statement of fact it may not be prohibited,” Martin writes. “However, where the line is drawn and when it is crossed can be a problem not just for the lawyer but for the client.”
