On the heels of the recent high-profile prisoner exchange between WNBA star Brittney Griner and Russian arms dealer Viktor Bout, Tom Firestone, Stroock partner and former Resident Legal Adviser at the U.S. Embassy in Moscow, discusses the continuing plight of Marc Fogel, a 61-year old American teacher held in Russian custody for possession of medical marijuana.

Firestone, a member of Fogel’s legal team, tells Time, “The Fogel family is very happy for the Griner family and hopes that the U.S. government will apply the same kind of effort to get Marc out. This is just an extremely unfair sentence and we hope that the U.S. government will do everything in its power to get Marc home safely.”

Firestone continues, “It seems pretty clear that they [Russia] have embarked on a policy of using Americans who are arrested in Russia as bargaining chips for other political ends, and we think that Mark got caught up in that.”
