As New York City Mayor Eric Adams and the City Council craft a bill to create a permanent outdoor dining program for the open-air sidewalk cafes and on-street dining structures constructed during COVID, Stroock special counsel John Egnatios-Beene examines the future of this street-based dining.
In a new article for Law360, John agrees outdoor restaurants are a good option on residential and commercial streets in the five boroughs, but putting structures on avenues with fast traffic isn't a good idea.
He continues: "[i]t's almost a street-by-street analysis. In my neighborhood of Fort Greene, Brooklyn, the restaurants are all overflowing. They are absolutely happy to keep as much seating as they can get, and the residents have adjusted. But you don't have to go very far to get to one of the large avenues, where outdoor dining was absolutely essential when people didn't want to dine inside, and now it's looking a little blighted and neglected. Nobody really likes dining on a busy avenue. They just did it out of necessity."
