In a article titled “Recordings: A Dirty Business Gone Worse?,” Stroock senior counsel Joel Cohen discusses surreptitious recording of witnesses and those in custody. Sharing a recent incident when the FBI and prosecutor failed to disclose in advance the recording of his client’s interview, Cohen questions the ethics of secretly recording conversations. Calling it a dirty business, Cohen warns criminal attorneys to ask whether their clients will be recorded before allowing interviews to go forward.
