The Consumer Financial Protection Bureau's amicus brief filed in relation to an ongoing dispute over the responsibilities loan servicers have regarding borrowers' questions signals the agencies broader intentions for the mortgage space, Partner Allen Denson tells National Mortgage News.

Regardless of what the brief may say about the CFPB, Allen notes that "courts are not required to accept that brief as authoritative."

"It's not the same thing... as rulemaking through notice and comment," he adds.
