In his latest article for the New York Law Journal, election lawyer Jerry Goldfeder looks at former Vice President Joe Biden’s recent statements expressing worry that President Donald Trump would attempt to delay the November election.

The article examines the constitutional issues surrounding the date of a presidential election along with who would assume the presidency if the election were delayed.

“Luckily, Congress is divided, ensuring that any modification of the calendar, as extraordinarily unique in our history as it would be, would have to be a bipartisan effort,” Jerry writes.
