Ethics for Patent Attorneys Prosecution and Litigation
(1) pre-filing investigations, such as undisclosed, but suspected on sale or public use bars;
(2) the duty to disclose relevant information to the patent office, and in particular, non-English language documents; and
(3) litigation considerations, in particular, whether the same attorney may obtain a patent or opine on its infringement and also litigate the patent.
