"The American Clean Energy and Security Act of 2009: Proposed Federal Cap-and-Trade Program"

On March 31, 2009, Congressmen Waxman (D – Cal.) and Markey (D – Mass.) released a discussion draft of the American Clean Energy and Security Act of 2009 (the “Draft Bill”), a comprehensive, 648-page energy bill that includes four titles: Title I – Clean Energy, Title II – Energy Efficiency, Title III – Reducing Global Warming Pollution, and Title IV – Transitioning to a Clean Energy Economy.  This Stroock Special Bulletin highlights key provisions of the cap-and-trade program contained in Title III of the Draft Bill.
