“Co-op and Condo Apartment Alterations – New NYC Department of Buildings Requirements for Work Permits”

Effective August 4, 2008, a new Form PW3 – Cost Affidavit – must be submitted to the New York City Department of Buildings (“DOB”) in connection with certain applications for work permits, including those for co-op and condo apartment alterations. The new PW3 requires that the applicant attest to the accuracy of the construction costs for the work, which determines the fees assessed by DOB for issuing a work permit. Previously this was required only from the applicant’s contractor. This Stroock Special Bulletin discusses the new requirements and how coop and condo boards can protect themselves from liability.
