“The New Patent Rules-What You Don’t Know Can Hurt You”
Patent applicants beware! Seeking to reduce skyrocketing delays in examining patent applications, the U.S. Patent and Trademark Office (“USPTO”) has announced sweeping changes to the patent application process that will significantly limit the protection available to anyone applying for a U.S. patent on or after November 1, 2007, and also will affect many applications that already are on file. The changes will be implemented through new and amended rules of practice (the “New Rules”) that will take effect on November 1, 2007. Some of the New Rules will necessitate substantial additional advance preparation by many applicants.
