Alisa Taormina is part of the Firm's Financial Services Litigation, Regulation and Enforcement Group and handles complex litigation, including both individual and class actions. In particular, Ms. Taormina has extensive knowledge of state and federal laws relating to debt collection, credit reporting, unfair business practices and other consumer protection statutes. 

Ms. Taormina represents an array of companies, including credit card issuers, mortgage lenders, consumer reporting agencies and student lenders.

Representative Matters

  • Obtained an opinion from Florida’s Fourth District Court of Appeal affirming a judgment of foreclosure in favor of HSBC Bank USA over appellants’ numerous arguments on evidentiary issues.
  • Obtained an Eleventh Circuit opinion affirming the dismissal of a putative class action filed against Trans Union LLC which asserted that TransUnion had violated Section 1681e(b) of the Fair Credit Reporting Act.  The case presented unique issues of fact and law related to consumer credit reporting, a field that is ever-evolving, that had not previously been addressed by the Eleventh Circuit.
  • Obtained dismissal for JP Morgan Chase in the Southern District of Florida in a case in which plaintiff claimed JPMorgan Chase violated Section 15 U.S.C. § 1681s-2(b) of the Fair Credit Reporting Act by failing to reasonably investigate complaints lodged with the consumer credit reporting agencies regarding its continued reporting of his loan as past due, even after he had satisfied the foreclosure judgment (which was done only after the loan was transferred to another lender).  The Eleventh Circuit upheld the dismissal and extended the often-cited rule established in Chiang v. Verizon New England Inc., 595 F.3d 26 (1st Cir. 2010), holding that, for a § 1681s-2(b) violation, the plaintiff is required to plead and prove a factual inaccuracy rather than the existence of a disputed legal question.
  • Alisa also serves as an attorney ad litem for children who have been abused, abandoned or neglected in Miami-Dade County.
