Stroock partner and former CFPB Assistant Director Quyen Truong was featured in a Law360 article titled “CFPB’s Structure Still Likely to Give Way in High Court Fight.”

With the upcoming vote in the Supreme Court on the constitutionality of the CFPB’s leadership structure fast approaching, the article weighs the likelihood of whether the high court will leave the agency’s structure intact.

“The potential for the court to strike down the entire [Title X] is very low,” Quyen says, “as it’s very unlikely to depart from the fundamental principle that courts should interpret the laws to avoid finding constitutional infirmity and broadly undoing congressional will — especially given that the statute has a severability provision.”
