In an article titled “Why Did Derek Chauvin Take the Fifth?,”  Stroock Senior Counsel Joel Cohen discusses the strange tactic Chauvin’s lawyer took in questioning his client regarding taking the Fifth Amendment. Cohen notes that although a defendant does not bear the burden of proving his innocence, by asserting the privilege against self-incrimination, Chauvin gave up his right to tell his story to the jury.
