Dale Degenshein, special counsel in Stroock’s national Real Estate Group, was recently published in Habitat.

Her article, “Who Can Go Out on the Roof?” relays the Fairmont Tenants Corp. vs. Braff case, which serves as a reminder that boards can successfully challenge a shareholder’s actions even if the shareholder engaged in a violating activity for a period of time with no resistance.
