In a New York Law Journal article titled “When a Legislator Threatens Retaliation: Obstruction?,” Stroock Senior Counsel Joel Cohen considers the conduct of House Minority Leader Kevin McCarthy and U.S. Representative Taylor Green. Whether or not they should be criminally prosecuted or is even prosecutable as a practical matter, the Congress itself, as an institution, Cohen says, needs to address this conduct, both for now and the future, by publicly censuring those engaged.
