The media has recently reported that Governor Cuomo’s administration misled the U.S. Justice Department’s Civil Rights Division regarding nursing home deaths. In his most recent column, senior counsel Joel Cohen addresses this subject, noting that prosecutorial discretion—the valuable practice of prosecutors often using their discretion to decline cases—suggests that there is no “criminal” case worth pursuing regarding the nursing homes.
