Stroock Partner Seema Misra will be speaking at "An Interactive Workshop: The Future of the Duty of Utmost Good Faith" presented by AIRROC and Freeborn & Peters LLP. The event will take place February 3, 2015 in East Princeton, NJ.
Ms. Misra will participate in the panel discussion "Point/Counterpoint: Utmost Good Faith and the Current Legal Landscape" at 9:30am.
The workshop will examine the well established principal of the duty of utmost good faith, the current legal landscape, as well as take a look forward as to the evolving ways that it is being applied by arbitrators and the courts.
The curriculum is based around a fact pattern involving excess of loss reinsurance covering a cyber insurance policy, the cedents' non-disclosure and subsequent settlement, and the reinsurer's right to associate. Participants will be divided into teams who will work to develop a negotiation strategy and work on a settlement with their counterparties.
