American Bar Association's 2015 Class Actions National Institute

Stroock Partner Julia B. Strickland will be speaking at American Bar Association's 2015 Class Actions National Institute in New Orleans, LA. The event will take place October 22-23, 2015.

Ms. Strickland will participate in the panel discussion "Who Dat Say Dey Gonna Beat Dem Plaintiffs?" The Supreme Court's Consideration of Rule 68 Offers of Judgment and Whether These Offers Parade Plaintiffs Out of Court.

Panel Overview:

Could beaucoup problems loom for all of us? The Supreme Court recently granted certiorari in Campbell-Ewald v. Gomez, where it will consider not only whether an offer of complete relief moots a plaintiff's individual claim but also "whether the answer to [this] question is any different when the plaintiff has asserted a class claim under Federal Rule of Civil Procedure 23[ ] but receives an offer of complete relief before any class is certified." On this issue, there seems to be no neutral ground; the Circuits are split. And if the Court says f'sho to both issues, what would that ruling mean for our practice and our class-action careers? So pull out your crystal ball as we try to understand how the Court's ruling could cause us either to prosper or parish.
